• Your user account is intended for individual use only. Sharing an account with multiple users is not allowed.
• You are responsible for the security of your email account and password. Devi is not liable for any loss or damage resulting from a breach of this security obligation.
• The Service must not be used for any illegal or unauthorized activities, including but not limited to copyright or trademark infringements.
• By using the Service, you affirm that you are at least 18 years old and have not been previously suspended or removed from the Service.
• If you suspect that your account's security has been compromised, you must immediately inform us at [email protected].
• As long as you comply with these Terms, Devi grants you a limited, non-transferable, non-sublicensable, and revocable permission to access and use the Service for your personal, internal use. This permission is contingent upon your payment of any applicable fees after any Free Trial Period.

2. Subscription & $1 Trial policy

Monthly Subscription Plan

• $1 will be charged as a setup fee for first 10 days of trial.
• Devi offers a 10-day trial for our monthly subscription plan. Your credit card or payment method will not be charged until the trial ends except the $1 setup fee.
• Seven days before your trial ends, we will send you a reminder of upcoming charges.
• Once your 10 days-trial period ends, your chosen subscription plan will commence, and your card will be charged according to the monthly billing cycle.
• We have an 'Anytime cancel and get Refund policy' for the current month.

Annual Subscription Plan

• The annual subscription plan is offered without a trial period.
• Upon subscribing to the annual plan, you will be charged immediately at the discounted annual rate.
• You have the flexibility to cancel the annual plan at any time under the "Anytime Refund" policy, with applicable refunds for the unused period

3. Pricing and Payment Policy

• Pricing Details:

  • Prices vary based on the selected plan and additional features.
  • Pricing is based on your geographical location, determined by your IP address, business location, or phone number's country code.
  • We reserve the right to change prices, and it's your responsibility to stay informed via our billing page at https://ddevi.com/billing.
  • Promotional offers with different features and pricing may be available and are applicable only if specifically offered to you.

• Recurring Payments:

  • Following a 10-day trial, Devi automatically charges for the subscribed product.
  • Billing occurs on the due date for each subscription period.

4. Anytime Cancellation & Refund Policy

Anytime Refund Policy

• Annual Subscription Plan:
  • Offered at a 50% discount, without a trial period.
  • Cancel at any time and receive a refund for the full amount of the current month and the remaining months. Past months are not eligible for refunds.
  • Refunds are calculated based on the full monthly rate, not the discounted annual rate.
• Monthly Subscription Plan:
  • $1 will be charged as a setup fee for first 10 days of trial.
  • Includes a 10-day trial. If cancelled within this period, no recurring charge will be applied except the setup fee.
  • Flexibility to cancel at any time post-trial, with refunds available for the current month's subscription fee. Past months are not eligible for refunds.
• Cancellations must be processed through our Billing page. Ensure the procedure is completed correctly to receive a 'Subscription Cancellation Successful' message.
• Avoid Chargebacks: Directly contact our support for any billing concerns instead of initiating a chargeback with your bank. This ensures quicker resolution and avoids credit history impacts.
• For assistance during cancellation, contact our support team please chat with us or send us an email.1

5. How to cancel your subscription:

• You need to go to the Billing page.
• Then click on the Cancel button.
• Follow the on-screen instructions to complete the cancellation process until you see "Subscription Cancellation Successful"
• We will send you an email proof for your records.

Please ensure you follow the cancellation procedure correctly and receive a 'Subscription Cancellation Successful' message to be eligible for a refund.

If you have any queries or encounter any issues during cancellation, we strongly encourage you to contact our support team, please chat with us or send us an email.

* Please note, we will first attempt to retain you by offering a free 1-on-1 setup call. If you still wish to proceed with the cancellation, we will present you with some exclusive discount offers to make you stay. Only after you continue with the cancellation will you receive a 'Subscription Cancellation Successful' message, marking the completion of the process.

6. User Responsibilities

• Staying Informed: Regularly check our Terms of Service, Privacy Policy, and Cancellation & Refund Policy. Continuing to use our Service after updates signifies your acceptance of those changes.
• Legal and Platform Compliance: Follow all applicable laws related to your use of our Service. This includes adhering to the terms and privacy policies of the social media platforms you interact with through our Service.
• Account Security: You're responsible for all activities under your account. Immediately inform Devi of any unauthorized use or security breaches.
• You are responsible for managing your login/logout of your social media account when using Devi, especially on public or shared devices. It's important to delete data from such devices after use. Devi assumes no liability for the use of our service on non-personal or multi-user devices.

7. Compliance with Social Media Platform and Third-Party Terms

• Prohibited Uses: The Tool must not be used for data scraping, generating fake engagement, or any activities that violate the terms of service, policies, or guidelines of social media platforms.
• Purpose of the Tool: The Tool is designed to enhance user productivity and improve the browsing experience on social media, including Facebook. • Scope of Responsibility: While AI content generation feature, it's important to note that Devi AI LLC is not responsible for the content generated, including text, images, and videos by the AI models and 3rd-party services.
• Generated Content: Any text, images, or videos that appear as a result of using our tool are the result of individual social media platform algorithms and user permissions. Devi AI LLC does not control or influence the generation of this content.
• User Discretion Advised: Users should exercise their discretion while interacting with content surfaced through our AI features. Devi AI LLC assumes no liability for any outcomes resulting from the interaction with or reliance on such generated content.

13. Account Restrictions and Limitations

• By using our browser extension, you acknowledge and agree that third-party platforms, including but not limited to Facebook, Instagram, Twitter, Reddit, LinkedIn, and other websites used for automation, may limit, restrict access, or suspend your account due to excessive activity. This is a result of these platforms' automated systems designed to protect the integrity of their services and is beyond our control.
• These restrictions are typically temporary, some may last 24 or more hours. During this time, you may be unable to use certain features of our extension and/or the platform. We recommend that you use our extension responsibly and avoid excessive activity that could trigger these restrictions.
• Devi AI LLC is not responsible for any actions taken by third-party platform including but not limited to Facebook, Instagram, Twitter, Reddit, LinkedIn, and other websites use by the extension, such as account suspensions, restrictions, or other penalties. By using our browser extension, you assume all risk associated with its use and agree not to hold Devi AI LLC liable for any negative consequences or damages arising from its use.

14. Governing Law

These Terms are governed by the laws of the State of Wyoming in the United States of America without regard to conflict of law principles.

Arbitration notice

You agree that disputes arising under these Terms will be resolved by binding, individual arbitration, and BY ACCEPTING THESE TERMS, YOU AND DEVI ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY OR TO PARTICIPATE IN ANY CLASS ACTION OR REPRESENTATIVE PROCEEDING. YOU AGREE TO GIVE UP YOUR RIGHT TO GO TO COURT to assert or defend your rights under this contract (except for matters that may be taken to small claims court). Your rights will be determined by a NEUTRAL ARBITRATOR and NOT a judge or jury.
